GENERAL NARRATIVE |
In the ongoing effort to reduce the problem of driving under the influence and related crashes, on the evening of Friday, December 19, 2014 the Kingsport Police Department conducted a sobriety checkpoint on Fort Henry Drive in the vicinity of Hammond Bridge in Kingsport. In a two-hour period from 11:00 PM until 1:00 AM, officers made two custodial arrests and issued an additional 15 citations for assorted traffic violations.
The first custodial arrest occurred shortly before midnight when Joseph Donnell Starks attempted to avoid contact with law enforcement when, upon spotting the checkpoint ahead, he turned his vehicle around in a parking lot just before the checkpoint and headed back in the opposite direction. When officers caught up with him, they found that his driver license was suspended. Mr. Starks was arrested for Driving on a Suspended License and transported to the Kingsport City Jail. The second custodial arrest came about an hour later when Anthony Jack Brogan was stopped at the checkpoint for having an expired license plate. When officers detected an odor of alcoholic beverage emanating from Mr. Brogan, he acknowledged consuming 4 or 5 beers at a friend’s house. After performing poorly on a series of field sobriety tests, he was arrested for 1) Driving Under the Influence, 2) Violation of Registration, 3) Failure to Comply with Financial Responsibility Law (No Insurance), and 4) Failure to Provide Notification of Change of Address. Upon his arrival at the Kingsport City Jail, his blood alcohol content registered .20 BAC which is 2 ½ times the legal limit of .08 BAC. In addition to the above arrests, fifteen citations were issued for the following traffic violations: 1) Violation of Registration (4 offenders) 2) Failure to Comply with Financial Responsibility Law/No Insurance (1 offender) 3) Seatbelt Law Violation (1 offender) 4) Light Law Violation (5 offenders) 5) Muffler and/or Noise Ordinance Violation (2 offenders) 6) Window Tint Violation (1 offender) 7) Failure to Provide Notification of Change of Address (1 offender) The Kingsport Police Department wishes to stress that Tennessee D.U.I. laws apply not just to alcohol, but to any substance that impairs, including illegal drugs, over-the-counter (OTC) medications, as well as prescription drugs, even if they are prescribed by a physician. |
