Statement of Mayor Dennis Phillips regarding the use of fireworks in Kingsport
Statement from Mayor Phillips:
“The previous county-wide ban on sale of fireworks fell under the county ordinance, and since that was repealed by the county, we have been operating without an ordinance to see how things develop. Needless to say, we have been overwhelmed by both the number of fireworks sellers that that have set up tents and the outpouring of concern from citizens about the potential for abuse of fireworks. This is now a priority for the Board of Mayor and Aldermen and I will be setting up a committee immediately to study the fireworks situation within the city. In the meantime, we ask everyone using fireworks to please respect their neighbors with regard to fireworks usage, restricting them to times and places that are appropriate. Beyond that, we wish everyone a happy and safe 4th of July holiday.”
In addition, the Kingsport Police Department stands ready to enforce the City’s existing nuisance ordinance, particular for egregious offenders who refuse to respect their neighbors.
ARTICLE II.‚ NUISANCE ACTIVITIES*
Sec. 66-56.‚ Definitions.
The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
Nuisance‚ means an action of any person in doing an unlawful act or in omitting to perform a duty or in suffering or permitting any condition or thing to be or exist, which act, omission, condition or thing either:‚
(1)‚ ‚ Injures or endangers the comfort, repose, health or safety of others;
(2)‚ ‚ Unlawfully interferes with, obstructs or tends to obstruct or renders dangerous for passage any public or private street, highway, sidewalk, stream or drainage;
(3)‚ ‚ In any way renders other persons insecure in life or the use of property; or
(4)‚ ‚ Interferes with the comfortable enjoyment of life and property or tends to depreciate the value of the property of others.
