SUBJECT: Kingsport Police Seatbelt Checkpoint Nets Significant Drug Arrest

GENERAL NARRATIVE
On September 3, 2015 at approximately 5:00 PM, several Kingsport Police Officers were working a Governor’s Highway Safety Office seatbelt enforcement checkpoint detail at the intersection of Konnarock Road and East Sevier Avenue in Kingsport. As a blue Chrysler PT Cruiser entered the checkpoint, the passenger, later identified as Marcus Antonio Simonton, was observed by the officers to not be wearing a seatbelt.

The officers directed the driver to pull the vehicle to the roadside and began the process of issuing a seatbelt violation citation. Officers soon learned that the female driver had obtained a Temporary Order of Protection against Mr. Simonton which prohibited him from being in close proximity to her. The officers ordered Mr. Simonton to exit the vehicle.

As he stepped from the vehicle, he became argumentative. As the officers attempted to place him under arrest, he became combative. He shoved one officer and tore another officer’s uniform shirt and traffic vest. As the officers attempted to handcuff him, he continued to aggressively resist, kicking one officer and inflicting various scrapes and abrasions to another officer.

During the course of the arrest, officers were forced to utilize both a Taser and pepper spray to gain control over Mr. Simonton and take him into custody. He was eventually placed in handcuffs and transported to the Kingsport City Jail. While searching him during the jail intake process, officers found a plastic baggie containing 38 individual aluminum foil packets in his pocket. The packets contained a white rock like substance believed to be Crack Cocaine.

As a result of this incident, Mr. Simonton was charged with:

1) Possession of a Schedule II Drug (Crack Cocaine) for Resale

2) Introduction of Contraband into a Penal Facility

3) Violation of a Temporary Order of Protection

4) Simple Assault on a Law Enforcement Officer (3 Counts)

5) Vandalism

6) Resisting Arrest

7) Evading Arrest

8) Violation of Seat Belt Law

He remains incarcerated in the Kingsport City Jail in lieu of a $20,000 bond as set by the presiding judge.
